Terms of Service

These Terms of Service ("Terms") govern your use of the Agentiq service and website (together, the "Service"), operated by HYROES SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ ("Hyroes", "we", "us"), with its registered office at ul. Ks. Józefa Poniatowskiego 42B, 05-230 Kobyłka, Poland, KRS 0001090861, NIP 1251764103, REGON 527948283.

By creating an account or using the Service, you agree to these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

1. The Service

Agentiq provides:

  • Content Posting API: a REST API for publishing, scheduling and managing content on third-party social networks (X, LinkedIn, Threads, TikTok, Instagram and YouTube, subject to availability).
  • AI Social Media Manager: an application that turns your ideas, pasted text and connected sources into draft content, and manages a publishing calendar.

We are continuously improving the Service. Features, formats and network support may change over time.

2. Accounts and Eligibility

You must be at least 16 years old to use the Service. You are responsible for:

  • Keeping your credentials secure
  • All activity under your account and organization
  • Ensuring that the people you add to your organization comply with these Terms

You must provide accurate information and keep it up to date.

3. Connecting Accounts and Publishing

To publish content you must connect your own accounts on third-party social networks. By connecting an account you authorize us to post, schedule and manage content on it through the Service.

You acknowledge that:

  • Each social network has its own terms of service, which you must comply with
  • Some networks (including TikTok) may require their own review or approval of our application before publishing features are available to you
  • We are not responsible for the actions, outages, rate limits or policy changes of third-party networks
  • Publishing is initiated at your instruction; we are not liable for the consequences of content you choose to publish

4. AI-Generated Content

The Service uses artificial intelligence to draft content based on your inputs. You acknowledge that:

  • AI output may be imperfect, and you should review it before publishing — nothing is published without your approval
  • AI-generated content is created at your direction and your responsibility
  • You are responsible for ensuring your content does not violate law or the rights of others (including intellectual property and defamation)

5. Your Content and Our License

You retain all rights to content you upload, create or publish through the Service ("Your Content"). You grant us a limited, worldwide, non-exclusive license to host, process and transmit Your Content solely to provide the Service to you, including subprocessing by service providers listed in our Privacy Policy.

We do not claim ownership of Your Content and we do not use it to train third-party models.

6. Acceptable Use

You agree not to misuse the Service, including:

  • Posting illegal, infringing, defamatory or fraudulent content
  • Attempting to access other accounts, systems or data
  • Reverse engineering, scraping or abusing the API beyond its documented limits
  • Interfering with the availability or security of the Service
  • Using the Service to send spam or unsolicited bulk content

7. API Keys

API keys are credentials. You must keep them confidential and store them securely (for example in environment variables, never in client-side code). You are responsible for all requests made with your keys. We may rotate or revoke keys to protect the Service.

8. Subscriptions, Payments and Refunds

  • Paid plans are billed in advance through our payment provider, Stripe
  • Subscriptions renew automatically until cancelled
  • You can cancel at any time from your account settings; access continues until the end of the paid period
  • Lifetime plans are one-time payments for lifetime access to the features available at the time of purchase; we do not offer refunds on lifetime plans unless required by law
  • Prices may change with notice; price changes do not affect your current billing period
  • Consumer rights granted by applicable law (including Polish consumer law) are not limited by this section

9. Intellectual Property

The Service, including its software, design, documentation and trademarks ("Agentiq" and related marks), is owned by Hyroes or its licensors. You may not copy, modify, distribute or create derivative works of the Service except as expressly permitted.

Documentation is provided for use with the Service; you may not republish it without permission.

10. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI output will be accurate, complete or suitable for publication.

11. Limitation of Liability

To the maximum extent permitted by law, Hyroes shall not be liable for indirect, incidental, special or consequential damages, or for loss of profits, data, goodwill or content, arising out of or related to your use of the Service.

Our total aggregate liability arising out of or related to these Terms or the Service shall not exceed the amounts you actually paid to us in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

12. Termination

You may stop using the Service at any time and delete your account from your settings. We may suspend or terminate access to the Service if you materially breach these Terms, if required by law, or to protect the security or integrity of the Service. Upon termination, your right to use the Service ends; you may export your data before termination where the Service offers export.

13. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Poland, without regard to conflict of law rules. Any disputes arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Poland competent for the registered office of Hyroes. Mandatory provisions of consumer protection law of your country of residence remain unaffected.

14. Changes to These Terms

We may update these Terms from time to time. We will post the updated version on this page and update the "Last updated" date. If changes are material, we will notify you by email at least 14 days before they take effect, where reasonably possible. Continued use of the Service after changes take effect constitutes acceptance.
